Terms of Service

1. GENERAL

These terms and conditions apply to all services performed by the artist Christina Wanke. If other written agreements have been reached between the parties, these take precedence over the terms and conditions.

2. COPYRIGHT

All images that come from the artist are protected by copyright. This also includes those in digital form and those that are on the website. All works were created by the artist herself. The rules of copyright law apply at both national and international level. The artist's consent must be obtained before any illustration, reproduction or publication of her work.

2.1. USE AND EXPLOITATION

Any use and exploitation must be made known to the artist in advance and is generally only permitted with her written consent. This only applies for the duration and for the purpose agreed between the parties.

2.2. DISTRIBUTION RIGHT according to §17 UrhG

A distribution of the works is prohibited under all circumstances without the consent of the artist. The artist must give her written consent before any distribution.

2.3. RIGHT OF REPRODUCTION according to § 16 UrhG

Reproduction of the works is prohibited under all circumstances without the consent of the artist. The artist must give her written consent before any reproduction. Basically, the artist gives orders for reproduction, such as postcards, posters, flyers, etc. herself.

2.4. NAME REFERENCE

When using the works, the name of the artist or the author must be clearly stated. If deviating written agreements between the parties apply, these take precedence over the General Terms and Conditions.

2.5. APPROPRIATE REMUNERATION

In terms of § 32 UrhG, the artist is entitled to appropriate remuneration for every use or application of her works.

3. ORDER ORDERING PROCESS

The client sends the artist a written and non-binding request, which must contain the following data:

1. Desired size

2. Technology

3rd canvas

4. Paper

5. Frame / No frame

6. Individual wishes

7. Delivery date

If certain motifs and recordings are required, they must be of good quality and sharpness by post or email in the formats jpg., Jpeg., Or bmp. sent. The duty of confidentiality and the rules on the careful storage of personal data according to the GDPR must be observed.

The order must be accepted in writing by the artist and is carried out via a written confirmation. As soon as the artist has finished the painting, a photo of the portrait or painting is sent to the client in order to obtain their final approval. If the client gives one-time approval, this triggers the due date of the remaining amount, which is to be paid from this point in time either immediately or at the latest within 10 days after completion. As soon as the payment is received in the artist's bank account, the painting is made ready for dispatch. The original photos are then sent back to the client. After completion of the order, all data will be deleted from the artist's database.

4. TERMS OF PAYMENT AND SHIPPING FOR LIMITED ART PRINTS, ORIGINAL SERVICES, ETC.

4.1 PRICES

The agreed prices apply for each contract execution. A deposit of 30% of the agreed price must be made beforehand, after which the order is only deemed to have been legitimately placed. From this point on, the artist begins to process the order.

4.2 TRANSPORT

The buyer is obliged to assume the transport costs for the plant. The shipping conditions can be agreed individually after consultation. Collection from the studio is also possible.

4.3 PAYMENT METHODS

The possible payment options are prepayment by bank transfer, PayPal payment or cash payment.

4.4 VAT

All remuneration and prices are given plus the statutory value added tax.

4.5 RESERVATION OF TITLE

The art prints and originals remain the property of the artist until the purchase price has been paid in full by the client.

4.6 DELIVERY PERIODS

The delivery times are generally 2 days to 21 days at the latest after payment of the full purchase price. The delivery times of the transport company selected by the customer must be taken into account. In the case of originals or commissioned work, the delivery also depends on the drying times of the factory.

5. RIGHT OF WITHDRAWAL

Every contractor has the right to withdraw from this contract within fourteen days without giving any reason.

6. RETURN POLICY

The buyer has the right to return the goods within 7 days, stating the reasons, after receiving the goods. The right of return can only be used for reasons of lack.

Defects do not include:

1. Slight deviations from the presentation on the Internet or on photos

2. Slight color deviations

3. Deviations in quality or technology and

4. Slight bumps.

The declaration of withdrawal must be submitted in writing (by letter or email). The services provided by both parties in the course of contract processing are to be postponed, with the exception of commissioned work and art prints (see below). The right of return only becomes legally effective as soon as the subject of the contract is returned. The buyer has to bear the transport costs of the return. In the case of commissioned work or art prints, the contractor cannot refund the entire purchase price. The effort already made (time, material costs, print order costs, etc.) must be deducted from this. These costs count as compensation owed to the artist. The remaining amount will be refunded to the customer.
